What information does Nicola collect about you?
Nicola collects information in a number of ways, and only ever with your consent. Information is collected as follows: when you submit your details in to the ‘contact’ form on the website; when you contact Nicola directly to enquire about her services; when you complete and submit the Health Questionnaire and/or other information-gathering paperwork upon first consultation with Nicola; and/or when you use Nicola’s services. The information collected will vary depending on which of the above means of communication are used. Nicola only collects information in line with the GDPR definition of consent: “any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.”
Nicola’s Data Processing is deemed lawful under article 6.1.a of the GDPR as “the data subject has given consent to the processing of his or her personal data for one or more specific purposes”; as is the case with Nicola’s group session clients; and/or article 6.1.b (b) where “processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract”; as is the case with all of Nicola’s Personal Training and Health Coaching clients with whom Nicola has a contract.
Consent can be withdrawn at any time by contacting Nicola by phone, email or in person (or where an electronic opt-out option is available).
In the unlikely event of a data breach, Nicola will contact the individual(s) concerned and where appropriate report the data breach to the ICO.
How will Nicola use the information about you?
When information is submitted via the ‘contact’ form on the website, Nicola collects this information in order to process and respond to your request for information and/or services. Please note that any information submitted via Nicola's website is secured by the website's Secure Socket Layer (SSL) Certificate, which safeguards and encrypts any submitted information.
For those wishing to sign up to receive email updates Nicola will use your name and email address to contact you in future by email regarding any services or events, etc., which she feels may be of genuine interest to you. You can unsubscribe at any time by contacting Nicola directly. If you are submitting your details in order to enquire about Nicola’s services, then you may also choose to input your location and how you heard about Vibrantly Alive. Location information is used to decipher how near/far you are located from Nicola, and the information you provide relating to how you heard about Vibrantly Alive is used by Nicola to identify and evaluate the effectiveness of different sources of referral.
When information (beyond contact information) is submitted directly to Nicola (by phone, email, through completion of a Health Questionnaire/Screening Form, and/or in person – within a Health Consultation for instance) at the point of enquiring about Nicola’s services, but prior to registering for these services, this information is used by Nicola to evaluate the suitability, safety and potential benefits of the service(s) for the individual. If the individual chooses to not use Nicola’s services, then this information will be securely destroyed, unless the individual requests that Nicola retain this information for potential future services.
In the instance of an individual registering for Nicola’s services (be this through attending a group class, or by entering in to a contract for Nicola’s services) information will be used to deliver the appropriate services to the individual and to maintain the suitability, safety and benefits of the service(s) provided for the individual. Contact details will be used for communication purposes relating to the services for which the individual has registered. This includes communication to inform the individual that the session is cancelled or postponed.
Marketing
Independent from communication relating to the services for which an individual has registered, you may also consent to receive email newsletters (either through opting in via an electronic form or by confirming you wish to do so directly with Nicola). If you choose to do so, then Nicola may occasionally send you information about her services, events, etc., which she feels may be of interest to you. If you have consented to receive marketing, you may opt out at a later date. You are very welcome to withdraw your consent to contact you for marketing purposes at any time. If you no longer wish to be contacted for marketing purposes, please email or call Nicola directly.
Access to your information and correction
Nicola takes the security of the information she holds very seriously. All paper files are securely kept within a locked location when not in use and are only every processed by Nicola. All electronic documents are saved securely to Nicola's laptop or cloud based folders, and are therefore password protected. Any highly sensitive information (such as a client's health details or the notes made by Nicola during a Health Coaching Session) are held in a password protected location or a Google Form Spreadsheet accessible only by Nicola. Any computer hardware is securely stored and password protected. Nicola will never share your information with any other person or company, unless compelled to by law.
You have the right to request a copy of the information that Nicola holds about you. If you would like a copy of some or all of your personal information, please email Nicola. Requests will be responded to within one month. Nicola has the right to refuse a request if she deems it excessive, in which case she must explain why and you have the right to complain to the statutory authority.
It is important to Nicola that your personal information is accurate and up to date, and that she only holds information about you which you are happy for her to hold. You may ask Nicola to correct or delete information you think is inaccurate, or which you deem no longer necessary for her to hold. Nicola will not keep any paper or electronic files for longer than 7 years following your last contact with her. After this time, any paper files will be shredded and any electronic files will be securely destroyed.
Cookies and Google Analytics
This website is hosted by GoDaddy. GoDaddy only use standard cookies on this website. Cookies are text files placed on your computer to collect standard internet log information and visitor behaviour information. These serve to enable your search engine to easily find the website again following your first visit to the website. You can set your browser not to accept cookies.
The website also uses Google Analytics to provide data regarding the geographic location (city or country) of the website user and the website which they linked to the website from (Google, Facebook, etc.). This information is used by GoDaddy to compile statistical reports on website activity for Nicola’s reference only. You can set your browser not to accept Google Analytics.

Minors
Nicola considers protection of the privacy of minors to be very important. Nicola’s services are not directed to minors under the age of 18, and she will not knowingly collect personal data from persons under the age of 18 without obtaining parental consent. If you are a parent or guardian and discover that your child under 18 years of age has obtained Nicola’s services, then you may alert Nicola and request that she delete that child’s Personal Data from her systems.
